Set out below are the Terms under which Captain John Manders performs maritime & offshore oil industry consulting services.
1. $ 2,000 retainer required. Invoice for services and expenses shall be paid at the address shown above within thirty (30) days of receipt of the invoice. A fee of 1 ½ % will be added to subsequent invoices for balances outstanding beyond thirty days.
2. Professional fees for service will be billed to you at the rate of $ 200.00 per hour for all time spent on your behalf. Local travel time = $95.00 per hour (mileage, tolls, parking)
The rate for court testimony and deposition testimony is $ 250.00 per hour.
3. All expenses incurred in connection with work or travel performed on your behalf shall be fully reimbursed by you. Domestic air fares shall be prepaid by you if requested, or reimbursed at the lowest fare available for the lowest class of service available at the time the travel arrangements are made. Flights to and from destinations outside of the continental United States shall be prepaid by you in business class rate if requested, or reimbursed at the lowest business class rate available at the time travel arrangements are made.
4. This agreement may be terminated by either party at any time, but you understand and agree that in the event you desire to terminate this agreement, you shall do so by giving written notice thereof delivered to the address set forth hereinabove, and shall remain liable for service fees and travel expenses incurred through the date and time of notice of termination is received.
5. The parties may, from time to time, expand or limit the scope of the work to be performed, but any modification or amendment of these Terms, or of any attachment, shall be in writing signed by the parties, otherwise it shall have no force or effect, and shall in no wise supersede these Terms or be enforced against them.
6. During and after the Term of this Engagement Capt. Manders will maintain in strict confidence and utmost secrecy all data and information to which he has had access or to which he may be exposed in the course of performance of services.
